MEDIA STATEMENT: PROTECTION OF PERSONAL INFORMATION ACT 4 OF 2013 CAUTIONS AGAINST PROCESSING OF PERSONAL INFORMATION OF DATA SUBJECTS WITHOUT THEIR CONSENT
On the 13th of July 2020 the Information Regulator released a media statement warning against the processing of data subjects information without their consent. This came about when images of the former President Jacob Zuma taken at the Department of Correctional Services were distributed on social media.
The regulator reminded the public that photographs that clearly identify an individual are regarded as personal information in terms of the Protection of Personal Information Act 4 of 2013 (“POPIA”) and that distribution of such material is regarded as processing of personal information in terms of the Act.
